These Terms of Service ("Terms") govern your use of creativeventuresbuffalo.com (the "Site") and the text messaging program operated by Creative Ventures Buffalo ("Creative Ventures Buffalo," "we," "us," or "our"), a property management company based in Buffalo, New York, operated by NY Creative Ventures LLC. By using the Site or opting in to our text messages, you agree to these Terms.
Our services
Creative Ventures Buffalo provides residential property management services in Buffalo and Erie County, New York, including tenant placement, rent collection, maintenance coordination, inspections, and lease administration. Information on the Site is general and does not create a management agreement; services are governed by the separate agreement signed with each owner, tenant, or contractor.
Text messaging (SMS) terms
Program description
Our text messaging program sends service-related messages to people who have opted in: tenants, rental applicants, and contractors or vendors. Messages include rent due reminders, maintenance scheduling and status updates, lease and renewal information, application status updates, viewing confirmations, work orders, and responses to your questions. We do not send marketing or promotional text messages.
Opt-in
You opt in by checking the text message consent box on a Site form or by signing the consent section of your rental application, lease, or contractor onboarding paperwork. Consent is optional and is not a condition of renting, applying, or working with us.
Message frequency and cost
Message frequency varies depending on your tenancy, application, or active work orders. Message and data rates may apply. Your wireless carrier's rates apply to each message sent and received.
Opting out
Reply STOP to any message at any time to cancel. You will receive one final confirmation message, and no further messages will be sent unless you opt back in.

Carriers and delivery
Carriers are not liable for delayed or undelivered messages. Delivery is subject to your carrier's network and may not be available in all areas or on all devices.
Privacy
Mobile numbers and opt-in consent data are used only to operate the messaging program and are never shared with or sold to third parties for marketing. See our Privacy Policy.
Acceptable use of the Site
You agree not to misuse the Site, including by submitting false information, attempting to disrupt the Site, or using the Site for any unlawful purpose.
Disclaimers
The Site is provided "as is" and "as available." We work to keep information accurate but make no warranties, express or implied, about the Site's content, availability, or fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, Creative Ventures Buffalo is not liable for indirect, incidental, or consequential damages arising from your use of the Site or the messaging program. Nothing in these Terms limits liability that cannot be limited under applicable law.
Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules.
Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above shows the current version. Continued use of the Site or the messaging program after changes means you accept the updated Terms.
